Terms of Service

These Terms of Service govern your use of the Shellvoide website, the KLUE platform, and our professional security services. KLUE performs real security testing, so please read the sections on authorized use and your responsibilities carefully. These terms form a legally binding agreement between you and Shellvoide.

Acceptance of Terms

By accessing or using the Shellvoide website (shellvoide.com), creating a KLUE account, or engaging our services, you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree, do not use our website, platform, or services.

These terms apply to all visitors, account holders, and clients.

Definitions

  • "KLUE" or the "Platform" means Shellvoide's AI penetration testing platform and dashboard.
  • "Services" means the Platform together with our professional security services, including penetration testing, red team operations, audits, training, and incident response.
  • "Subscription" means a paid KLUE plan, such as Starter, Pro, or Enterprise.
  • "Customer Data" means the targets, code, configurations, credentials, findings, and reports you submit to or generate with the Platform.
  • "SOW" means a Statement of Work or service agreement for a professional engagement.
  • "Target" means any system, application, repository, cloud tenant, or asset you direct the Platform or our team to test.

Accounts and API Keys

To use KLUE you must register for an account with accurate information and keep your credentials secure. You are responsible for all activity under your account and API keys.

  • Keep your password and scoped API keys confidential. An API key carries the access of the workspace that created it.
  • Notify us immediately of any unauthorized use of your account.
  • Workspace administrators control roles, invitations, and access for their users.
  • You must be at least 18 years old and able to form a binding contract to use the Services.

Subscriptions, Billing, and Renewal

KLUE Subscriptions are sold on a recurring basis and billed in advance through a third-party payment processor.

  • Plans are billed monthly in US dollars unless an order form or Enterprise agreement states otherwise. Enterprise plans may be billed annually with custom terms.
  • Subscriptions renew automatically at the end of each billing period until cancelled.
  • You can change or cancel your plan at any time. Cancellation stops future renewals; access continues until the end of the current paid period.
  • Plan limits, quotas, and concurrency apply as described for your plan. Usage beyond plan limits may require an upgrade or pay-as-you-go top-ups.
  • We may change pricing on reasonable prior notice, effective from your next billing period.

Refunds and cancellations are governed by our Refund Policy, which forms part of these terms.

Authorized Use and Your Responsibilities

KLUE performs active security testing that interacts with real systems. You may only test Targets that you own or are explicitly authorized in writing to test.

You represent, warrant, and agree that, for every Target you submit:

  • You own the Target or have obtained explicit, current, written authorization from its owner to perform security testing on it.
  • You have authority to grant Shellvoide and the Platform access to the Target and any connected accounts, repositories, or cloud tenants.
  • Your use complies with all applicable laws, your contracts with third parties, and the acceptable use policies of any underlying provider.

You are solely responsible for the scope you configure and the Targets you select. Shellvoide does not verify ownership or authorization and relies entirely on your representations. Performing security testing against systems you are not authorized to test may be unlawful.

Acceptable Use

You agree not to use the website, Platform, or Services to:

  • Test, scan, or attack any system you do not own or are not authorized to test.
  • Violate any law, regulation, or third-party right.
  • Circumvent, disable, or interfere with security or usage limits, quotas, or tenant isolation.
  • Reverse engineer, copy, or create derivative works of the Platform, except where this restriction is prohibited by law.
  • Resell or provide the Platform to third parties without our written consent.
  • Upload malicious code, or use the Services to develop or distribute malware for unlawful purposes.
  • Attempt to gain unauthorized access to our systems or to other customers' data.

We may suspend or terminate access for any violation of this section.

Customer Data and License

As between you and Shellvoide, you retain all rights to your Customer Data. You grant us a limited, non-exclusive license to host, process, and transmit Customer Data solely to provide and support the Services, including processing by the sub-processors described in our Privacy Policy.

Where we process personal data contained in your Customer Data, we act as your processor under our Privacy Policy and, where applicable, a Data Processing Agreement. You are the controller of that data and are responsible for having a lawful basis to provide it and to have it tested.

Artificial Intelligence and Findings

KLUE uses artificial intelligence and large language models to plan tests, generate exploit attempts, and interpret results. Because of the nature of AI and of security testing:

  • Findings are produced on a point-in-time basis, may be incomplete, and may include false positives or false negatives.
  • Automated output can contain errors. You should review findings before acting on them, and we recommend human validation for critical decisions.
  • A scan that reports no issues does not guarantee that a Target is secure or free of vulnerabilities.
  • Reports and compliance mappings are informational and do not constitute certification, legal advice, or a guarantee of regulatory compliance.

You are responsible for how you use findings and reports.

Third-Party Services

The Platform integrates third-party services, including AI model providers, our sandbox and compute provider, your connected source control provider, and our payment processor. Your use of features that depend on these services may be subject to their terms. We are not responsible for third-party services that we do not control. See our Privacy Policy for how data is shared with sub-processors.

Intellectual Property

The Platform, website, and all related software, content, trademarks, and methodologies are owned by Shellvoide and protected by intellectual property laws. Except for the rights expressly granted here, we reserve all rights. You may not reproduce, distribute, or create derivative works from our materials without written permission.

Reports and deliverables produced for you become your property upon full payment. Shellvoide retains ownership of its tools, techniques, and know-how, and may use aggregated and anonymized data and findings to operate and improve the Services. If you give us feedback, you grant us a perpetual, royalty-free license to use it.

Confidentiality

Each party may receive confidential information from the other. Both parties agree to protect the other's confidential information and to use it only as needed to perform under these terms. Shellvoide will not disclose your data, findings, or reports to third parties without your consent, except to sub-processors as described in our Privacy Policy or as required by law. You agree to keep our non-public methodologies, tools, and pricing confidential.

Professional Services

The scope, deliverables, timelines, and fees for professional engagements, such as penetration tests, red team operations, audits, and training, are defined in a separate SOW or service agreement. All such engagements are conducted only with explicit written authorization from the system owner. If a signed SOW conflicts with these terms, the SOW governs for that engagement.

Service Availability

We work to keep the Platform available and reliable, but the Services are provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features, and we may carry out maintenance. Features labelled beta or experimental may change or be withdrawn. Any service level commitments apply only if stated in a written agreement.

Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Shellvoide does not warrant that the Services will be uninterrupted, error-free, or secure, or that all vulnerabilities will be discovered. Security testing identifies issues at a point in time and does not guarantee that systems are fully secure.

Limitation of Liability

To the maximum extent permitted by law, Shellvoide will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Services, even if advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these terms or the Services will not exceed the amount you paid to Shellvoide for the Service giving rise to the claim in the 12 months before the event that gave rise to the liability.

Indemnification

You agree to indemnify and hold Shellvoide harmless from any claims, damages, losses, and costs (including reasonable legal fees) arising from your Customer Data, your use of the Services, your selection of Targets, or your breach of these terms, including any claim that you were not authorized to test a Target.

Suspension and Termination

You may stop using the Services at any time and cancel your Subscription as described above. We may suspend or terminate your access if you breach these terms, fail to pay, or use the Services in a way that risks harm to us, other customers, or third parties.

On termination, your right to use the Services ends. We will make your data available for export for a limited period and then delete it in line with our Privacy Policy, subject to legal retention obligations. Sections that by their nature should survive, including confidentiality, intellectual property, disclaimers, limitation of liability, and indemnification, survive termination.

Governing Law and Disputes

These Terms of Service are governed by the laws of the State of New Mexico, United States, without regard to its conflict of laws rules. The parties will first try to resolve any dispute in good faith. If that fails, disputes will be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico, unless a signed agreement specifies binding arbitration or another venue. Nothing in this section limits mandatory consumer rights you may have under the laws of your country of residence.

Changes to Terms

We may modify these Terms of Service from time to time. Changes will be posted on this page with an updated date and, for material changes, communicated where appropriate. Continued use of the website, Platform, or Services after changes take effect constitutes acceptance of the revised terms.

By using this website, you agree to our use of cookies as described in our Privacy Policy.

Essential Cookies are used by default to ensure the website operates correctly, including theme preferences and session management. These cannot be disabled.
